How is Amber Heard paying for all this? We heard her testify that she paid over 6 Million Dollars defending the defamation lawsuit….but did she? Her insurance companies are fighting over who should pay for her legal defense and it has a lot of details. Furthermore, her insurance company New York Marine is suing her for a judgment, saying they don’t have to pay for her lawyers or her Judgement. There is also the question of the suspension bond, will Johnny Depp be able to go after Amber Heard for the $10 Million judgment? Judge A made clear any suspension bond would need to be the full amount of the judgment plus the 6% interest. It will be interesting to see where this goes from here.

00:00:00:03 - 00:00:03:15

Welcome back to this week's

episode of The Emily Show.

00:00:03:15 - 00:00:04:05

And today

00:00:04:05 - 00:00:07:04

we are exploring a question

that I get asked so much

00:00:07:21 - 00:00:10:26

How is Amber

Heard paying for all of this?

00:00:11:02 - 00:00:12:24

How is she paying

for the appeal?

00:00:12:24 - 00:00:14:14

How did she pay for her case?

00:00:14:14 - 00:00:18:18

And to do that, we need to

explore the insurance cases.

00:00:18:27 - 00:00:20:29

So a few have heard

about the insurance cases

00:00:20:29 - 00:00:22:19

and are wondering

what's going on.

00:00:22:19 - 00:00:25:12

The reason I say cases

is because there are two

00:00:25:19 - 00:00:27:28

and we need to explore them now.

00:00:27:28 - 00:00:29:03

So today I'm breaking down

00:00:29:03 - 00:00:32:15

both of the insurance cases

and the judge's statements

00:00:32:15 - 00:00:35:27

at the June 24th hearing

about the suspension bond.

00:00:36:03 - 00:00:38:24

And what Amber Heard

has to pay for her appeal.

00:00:39:01 - 00:00:41:11

So we just need to get into it.

00:00:41:11 - 00:00:43:19

It's it's multiple cases

00:00:43:27 - 00:00:47:13

and it's look, it's

nerdy lore, interesting stuff.

00:00:47:13 - 00:00:49:13

And I can't wait to break it

down. So let's just get going.

00:00:49:27 - 00:00:51:28

Hey there.

Welcome to the Emily Show.

00:00:52:01 - 00:00:54:02

I'm your host, Emily Baker,

00:00:54:02 - 00:00:57:01

badass lawyer and everyone's

favorite legal commentator

00:00:57:05 - 00:00:59:04

breaking down the legal shit

in the news

00:00:59:04 - 00:01:01:15

and pop culture stories

you want to talk about.

00:01:02:03 - 00:01:04:13

I've been a licensed attorney

for over 15 years.

00:01:04:14 - 00:01:08:23

I'm a former prosecutor and I'm

a big fan of the crazy where.

00:01:08:23 - 00:01:17:14

So let's break it down.

00:01:17:25 - 00:01:20:09

A huge thank you to today's

sponsor, Manscaped.

00:01:20:10 - 00:01:22:14

July might be almost over, but,

00:01:22:14 - 00:01:24:12

you know,

August is just as swampy.

00:01:24:12 - 00:01:26:08

So you want to make sure

00:01:26:08 - 00:01:30:27

that your haircare for down

there is in tip top shape.

00:01:30:27 - 00:01:33:10

Look, it's still pool

season, people.

00:01:33:18 - 00:01:37:22

We want to make sure that we are

all the way together.

00:01:37:27 - 00:01:39:12

So why not get the product

00:01:39:12 - 00:01:41:23

that everyone in your household

can enjoy?

00:01:41:26 - 00:01:44:12

Manscaped

is the leader in the men's

00:01:44:12 - 00:01:46:02

below the belt waist grooming,

00:01:46:02 - 00:01:47:26

but I use

a lot of their products

00:01:47:26 - 00:01:51:18

and really enjoy them

and the kiddos use

00:01:51:19 - 00:01:53:22

their personal wash products

00:01:53:29 - 00:01:57:13

because they smell good

without smelling too much

00:01:57:22 - 00:01:59:23

and they have a spray

on moisturizer

00:01:59:29 - 00:02:03:11

that makes summer moisturizing

really easy.

00:02:03:18 - 00:02:06:16

I appreciate it,

but my favorite is

00:02:06:22 - 00:02:08:29

well, it's

a tie between the lawnmower 4.0

00:02:08:29 - 00:02:12:28

for all your bush

trimming needs down there.

00:02:13:03 - 00:02:15:18

It even has a light and

you can use it in the shower.

00:02:15:26 - 00:02:17:29

But also the weed whacker.

00:02:18:06 - 00:02:19:28

I can't talk enough about this

product.

00:02:19:28 - 00:02:22:18

Look, if you don't think nose

hair matters, it matters.

00:02:23:02 - 00:02:24:14

And you will notice

how much it matters

00:02:24:14 - 00:02:26:09

once you get your own weed

whacker.

00:02:26:09 - 00:02:28:19

If you want to try

their most popular products,

00:02:28:19 - 00:02:31:01

the performance package

has got you covered.

00:02:31:11 - 00:02:33:17

That package is for your package

00:02:33:21 - 00:02:39:24

with the lawnmower 4.0, the weed

whacker, the beloved crop

00:02:39:26 - 00:02:42:25

preserver,

which is a bowl deodorant,

00:02:42:25 - 00:02:45:20

and the crop reviver,

which is a spray on ball toner.

00:02:45:26 - 00:02:46:16

Look,

00:02:46:24 - 00:02:48:13

they're not for my bits

and pieces,

00:02:48:13 - 00:02:49:28

but they might be for yours.

00:02:49:28 - 00:02:51:21

It also comes

with two free gifts,

00:02:51:21 - 00:02:53:20

including the shed travel bag

00:02:53:20 - 00:02:57:05

and the reduced

chafing manscaped boxers.

00:02:57:05 - 00:02:57:23

But ladies,

00:02:57:23 - 00:02:59:20

if you're just looking

to purchase for you,

00:02:59:20 - 00:03:02:08

I would absolutely suggest

trying

00:03:02:16 - 00:03:07:04

the shaving products, the weed

whacker, the lawnmower.

00:03:07:22 - 00:03:09:10

They are fantastic.

00:03:09:10 - 00:03:11:13

00:03:25:25 - 00:03:29:12

they work fantastically.

Give it a try for yourself.

00:03:29:28 - 00:03:32:19

And with that, let's get

back into today's episode.

00:03:33:26 - 00:03:35:16

So where we are so far

00:03:35:16 - 00:03:39:09

in the Johnny Depp Amber

Heard case is that Johnny Depp

00:03:39:09 - 00:03:41:17

was kind of a big winner

after jury trial.

00:03:41:17 - 00:03:43:21

He won all three

of his causes of action

00:03:43:27 - 00:03:46:17

and won over $10

million in damages.

00:03:46:23 - 00:03:48:19

It was 10 million

and compensatory,

00:03:48:19 - 00:03:51:14

5 million and punitive.

Those are the punishment ones.

00:03:51:21 - 00:03:54:01

The punitive damages

got reduced by law

00:03:54:02 - 00:03:56:04

because in Virginia,

they're like, you can't do that.

00:03:56:08 - 00:03:58:13

The max is 350,000.

00:03:58:13 - 00:03:59:21

They don't tell the jury that.

00:03:59:21 - 00:04:01:28

So the jury awarded

what they wanted to and punitive

00:04:02:04 - 00:04:04:24

they thought 5 million

was punishment for the behavior.

00:04:04:24 - 00:04:06:06

I'm surprised

they didn't pick seven.

00:04:06:06 - 00:04:09:24

Like if they're going that high,

why not just pick seven

00:04:10:01 - 00:04:12:18

that was pledged

and not donate it? I don't know.

00:04:12:19 - 00:04:16:28

But they did so ten and five

reduced to 350. So 10.3 million.

00:04:17:18 - 00:04:20:27

Amber Heard won one of her

causes of action against Johnny

00:04:20:27 - 00:04:23:18

Depp for statements

made by Adam Waldman.

00:04:23:26 - 00:04:25:26

So whenever the media talks

about the fact

00:04:25:26 - 00:04:27:09

that Amber Heard didn't

even mention

00:04:27:09 - 00:04:28:08

Johnny Depp's name,

00:04:28:08 - 00:04:31:04

they never seem to mention

the fact that Johnny Depp

00:04:31:09 - 00:04:33:12

didn't even say shit.

00:04:33:12 - 00:04:34:18

But I digress.

00:04:34:18 - 00:04:37:07

It's one of the inconsistencies

that has made me

00:04:37:13 - 00:04:40:08

absolutely crazy in watching

the reporting on this case.

00:04:40:15 - 00:04:43:02

Amber

Heard didn't even say his name.

00:04:43:02 - 00:04:46:14

Okay, Johnny Depp

didn't say anything.

00:04:47:08 - 00:04:50:15

So if we're keeping that energy,

I'm here for it.

00:04:50:27 - 00:04:53:26

With that,

we got into both parties

00:04:53:26 - 00:04:55:23

filing their notice of appeal.

00:04:55:23 - 00:04:58:13

A notice of appeal means

I'm going to appeal.

00:04:58:22 - 00:05:02:08

Both of them filed the

appropriate appeal bond of $500.

00:05:02:14 - 00:05:05:27

The question is, what about the

suspension of judgment bond?

00:05:06:04 - 00:05:08:05

Does it have to be filed or not?

00:05:08:05 - 00:05:08:27

And we're going to talk

00:05:08:27 - 00:05:12:01

about what judge as karate

had to say about that,

00:05:12:07 - 00:05:14:06

because there is still

conflicting

00:05:14:06 - 00:05:16:07

information about it.

We will see.

00:05:16:13 - 00:05:18:09

The deadline

is going to be Monday

00:05:18:09 - 00:05:21:17

before this episode's released,

but after it's recorded.

00:05:21:22 - 00:05:23:16

So we'll see what happens.

There will be a note.

00:05:23:16 - 00:05:26:10

Check the show notes,

check my check.

00:05:26:14 - 00:05:27:16

If luck,

00:05:27:16 - 00:05:30:01

whatever information comes out,

I will probably do a short

00:05:30:01 - 00:05:31:10

about it over on the quick bits

00:05:31:10 - 00:05:34:27

channel or on Instagram or

tik-tok. So check the socials.

00:05:35:06 - 00:05:37:13

There will be an update

and we'll see.

00:05:37:13 - 00:05:41:02

So with that, we have both

parties filing notice of appeal.

00:05:41:02 - 00:05:43:24

Each party

has three months to file

00:05:43:24 - 00:05:45:19

their brief,

the appellate brief,

00:05:45:19 - 00:05:47:26

what they're going to tell us

about what they're going to

00:05:47:27 - 00:05:48:06

you know,

00:05:48:06 - 00:05:49:28

if ever there was an episode

00:05:49:28 - 00:05:52:15

to be sponsored by Andrew, did

we talk about how good

00:05:52:15 - 00:05:54:18

the Manscaped underwear

was in this episode?

00:05:54:18 - 00:05:56:16

Because if we didn't,

they're boxers,

00:05:56:16 - 00:05:58:25

you know, they're not a brief,

but they're still great.

00:05:59:06 - 00:06:01:14

So with that,

00:06:01:14 - 00:06:04:05

the briefs are going to be filed

within three months.

00:06:04:05 - 00:06:05:13

Should they be filed sooner?

00:06:05:13 - 00:06:06:28

Yes. Yes, they could.

00:06:06:28 - 00:06:09:09

And that's

going to lay out the law,

00:06:09:09 - 00:06:12:05

the rulings,

the issues that each party have.

00:06:12:05 - 00:06:14:16

This is why we think

there needs to be a new trial.

00:06:14:17 - 00:06:17:10

This is why we think it should

be less of a judgment award.

00:06:17:10 - 00:06:19:18

This is why the jury can't do

what they did.

00:06:19:18 - 00:06:21:12

All of that stuff

will be in the appellate brief

00:06:21:12 - 00:06:24:10

and at that point, we can

evaluate the law and the facts

00:06:24:19 - 00:06:26:19

as they're presenting it

to the appellate court.

00:06:26:19 - 00:06:28:26

And then the judges or judge on

the appellate court

00:06:28:26 - 00:06:31:12

is going to decide

what happens on appeal.

00:06:31:12 - 00:06:33:17

So that's

where we're at with the appeal.

00:06:34:03 - 00:06:39:24

But because we know that Amber

Heard had a judgment against her

00:06:39:24 - 00:06:43:15

of over $10 million,

and because her lawyer, Lane,

00:06:43:21 - 00:06:46:03

went on all of the morning

shows very quickly

00:06:46:16 - 00:06:47:27

right after the verdict

00:06:47:27 - 00:06:49:27

and talked about the fact

that Amber Heard doesn't

00:06:49:27 - 00:06:51:10

have the money

to pay the judgment,

00:06:51:10 - 00:06:54:18

the question came up,

what about the bond

00:06:54:18 - 00:06:55:19

for the appeal?

00:06:55:19 - 00:06:59:17

And again, the $500 bond to file

the notice of appeal

00:06:59:17 - 00:07:02:23

has been paid by both parties,

it seems, based on the filings.

00:07:03:04 - 00:07:05:22

But the judge talked

00:07:05:22 - 00:07:07:09

about the suspension bond

00:07:07:09 - 00:07:10:00

when the judge entered

the judgment

00:07:10:20 - 00:07:14:09

against Amber Heard

and Johnny Depp on June 24th.

00:07:14:17 - 00:07:17:16

And we're going to take a look

at that transcript right now.

00:07:18:21 - 00:07:20:29

So during the June 24th hearing,

00:07:21:10 - 00:07:24:21

they talked about whether things

would be sealed or unsealed.

00:07:24:29 - 00:07:27:28

And we know

and I've talked about previously

00:07:28:05 - 00:07:30:16

that a bunch of things

are going to be unsealed.

00:07:30:16 - 00:07:33:05

When that happens, we'll start

looking at those documents.

00:07:33:14 - 00:07:35:24

They have been crowdfunded

00:07:35:24 - 00:07:36:22

by Andrea

00:07:36:22 - 00:07:38:28

Burkhart over on Twitter,

who also has a YouTube

00:07:38:28 - 00:07:40:09

channel, is also a lawyer

00:07:40:09 - 00:07:42:13

that's been covering this case

for a substantial

00:07:42:13 - 00:07:43:17

amount of time,

00:07:43:17 - 00:07:46:12

and I believe others are going

to be obtaining them as well.

00:07:46:12 - 00:07:48:22

So we will at some point,

we will see them

00:07:48:22 - 00:07:50:18

and we will cover them

and go over them.

00:07:50:18 - 00:07:54:12

So when things get unsealed,

it's going to be

00:07:54:20 - 00:07:57:07

thousands of pages of documents

to go through.

00:07:57:14 - 00:07:58:16

I hope there's a group effort.

00:07:58:16 - 00:08:00:02

I need to reach out

to the lawyers and be like,

00:08:00:02 - 00:08:01:27

How are

we dividing the outlines?

00:08:03:15 - 00:08:04:11

Like law school?

00:08:04:11 - 00:08:06:08

What motions are people covering

and what?

00:08:06:08 - 00:08:07:17

Just divide up the work it's

00:08:07:17 - 00:08:12:28

going to be so many documents,

but at the end of that hearing,

00:08:12:28 - 00:08:15:05

when they were talking about

unsealing things,

00:08:15:21 - 00:08:16:29

then we have Ms..

00:08:16:29 - 00:08:19:13

Bright a half a lane saying

00:08:19:24 - 00:08:22:05

and we will answer quote,

00:08:22:05 - 00:08:23:26

We'll look for it

and we'll answer no later

00:08:23:26 - 00:08:26:05

than next Friday when we file it

with the post-trial motions.

00:08:26:05 - 00:08:27:25

Your Honor, the court says,

All right,

00:08:27:25 - 00:08:30:06

Alayne says on the seal,

the court says, that's fine.

00:08:30:14 - 00:08:32:19

And when you appeal,

00:08:32:19 - 00:08:37:15

there will be a suspension

bond to you understand that?

00:08:38:04 - 00:08:39:16

That's the court.

00:08:39:16 - 00:08:41:14

And when you appeal,

00:08:41:14 - 00:08:46:21

there will be a suspension

bond to not a there may be not a

00:08:46:22 - 00:08:48:08

you can ask for one.

00:08:48:08 - 00:08:50:12

There will be.

00:08:50:12 - 00:08:52:28

So it's my understanding,

based on what

00:08:52:28 - 00:08:54:19

the judge is saying

in this case,

00:08:54:19 - 00:08:56:20

that the judge anticipates

a suspension

00:08:56:20 - 00:08:59:11

bond will be put into place.

00:08:59:11 - 00:09:00:18

Emily, what does that mean?

00:09:00:18 - 00:09:01:06

Okay, real quick,

00:09:01:06 - 00:09:02:08

a suspension bond

00:09:02:08 - 00:09:05:06

means that you need to put up

the amount of the judgment

00:09:05:06 - 00:09:05:21

while the judge

00:09:05:21 - 00:09:07:22

is going to tell them

how much they need to put up

00:09:07:22 - 00:09:09:05

so that the other parties

00:09:09:05 - 00:09:10:27

not trying to collect your bond,

well,

00:09:10:27 - 00:09:13:09

they or collect their judgment

while you're appealing.

00:09:13:17 - 00:09:15:03

It's almost like escrow.

00:09:15:03 - 00:09:17:16

You put all the money in escrow

and if you lose your appeal,

00:09:17:16 - 00:09:19:04

it goes to the party

it's supposed to go to.

00:09:19:04 - 00:09:21:04

If you win your appeal,

it goes back to you

00:09:21:04 - 00:09:24:03

or stays in escrow until

whatever happens next happens.

00:09:24:10 - 00:09:26:20

So it's a way to make sure

that it's

00:09:27:07 - 00:09:31:17

not an appeal as a delay tactic

to just not pay. Right.

00:09:31:26 - 00:09:34:06

So there's a lot of

circumstances

00:09:34:06 - 00:09:36:10

where we've seen different

type of appeals bond

00:09:36:17 - 00:09:37:13

be put into place

00:09:37:13 - 00:09:41:00

in cases that we've covered,

particularly for our purposes

00:09:41:00 - 00:09:43:12

because I cover so much

that's in the trial of a court.

00:09:43:21 - 00:09:47:02

We see appeals

with preliminary injunctions.

00:09:47:09 - 00:09:49:17

When you get a preliminary

injunction,

00:09:49:17 - 00:09:51:12

there is generally a bond

00:09:51:12 - 00:09:54:26

that can be enforced against you

for the losing side,

00:09:55:02 - 00:09:57:03

because if you're delaying

something,

00:09:57:03 - 00:09:59:07

you know, on and on and on.

00:09:59:07 - 00:10:03:26

So we've seen that in the Nike

mischief case.

00:10:03:26 - 00:10:07:19

We've seen that in the dress

designer case.

00:10:07:19 - 00:10:08:28

We've seen it

in a few other cases

00:10:08:28 - 00:10:11:19

where a bond is posted

due to a preliminary injunction.

00:10:11:26 - 00:10:14:10

This is a post-trial suspension

bond.

00:10:14:10 - 00:10:17:13

So let us not delve

into that anymore.

00:10:17:13 - 00:10:19:15

But look at what the judge said.

00:10:19:15 - 00:10:21:06

The Court That's fine.

00:10:21:06 - 00:10:22:09

And when you appeal,

00:10:22:09 - 00:10:25:24

there will be a suspension

bond to you understand that?

00:10:26:06 - 00:10:28:13

Alayne

We plan on addressing that

00:10:28:13 - 00:10:30:17

with the post-trial motions,

Your Honor,

00:10:30:17 - 00:10:32:20

she didn't spoiler alert.

00:10:32:20 - 00:10:33:24

It wasn't mentioned

00:10:33:24 - 00:10:37:15

in any of the post-race

file motions that I've seen.

00:10:37:22 - 00:10:39:22

And I think

we covered them all here.

00:10:40:04 - 00:10:42:15

So Alayne says

we plan on addressing it

00:10:42:15 - 00:10:43:12

with post-trial motion.

00:10:43:12 - 00:10:45:15

The court said, Well,

I can address it right now

00:10:45:15 - 00:10:46:15

if you want a lane

00:10:46:15 - 00:10:48:23

cut off the court and said,

I'd prefer to be able to.

00:10:48:23 - 00:10:51:21

And the court says,

I understand what you prefer.

00:10:52:27 - 00:10:56:20

Ooh, okay, Your Honor,

I understand what you prefer,

00:10:56:20 - 00:10:57:28

but I'm going to tell you,

00:10:57:28 - 00:10:59:04

the suspension bond

00:10:59:04 - 00:10:59:13

would be

00:10:59:13 - 00:11:03:16

the amount of the judgment

plus 6% interest for a year,

00:11:03:22 - 00:11:06:26

because that's

what it should be,

00:11:06:26 - 00:11:11:24

the amount of the judgment

plus 6% interest for the year.

00:11:12:08 - 00:11:15:17

So the court is telling Alayne

there will be a suspension bond

00:11:15:22 - 00:11:18:19

and it will be 10.3

million plus 6% interest.

00:11:19:13 - 00:11:20:17

Ms. Bright A half OC.

00:11:20:17 - 00:11:23:06

The Court Okay,

so that's one less thing I have.

00:11:23:10 - 00:11:25:10

You have to address. Ms.

Bright of Hot.

00:11:25:25 - 00:11:29:06

Well, Will, Your Honor

permit me to at least address

00:11:29:06 - 00:11:31:21

that in the post-trial motions,

00:11:31:21 - 00:11:34:12

and the court says if you wish,

but that's my order right now.

00:11:34:12 - 00:11:36:28

Alayne says, I understand,

completely understand.

00:11:36:28 - 00:11:38:03

The court says, okay.

00:11:38:03 - 00:11:40:04

Elaine says,

Thank you, Your Honor.

00:11:40:04 - 00:11:42:04

The court says, All right,

anything further bent?

00:11:42:04 - 00:11:43:29

You says, No, Your Honor.

Thank you very much.

00:11:43:29 - 00:11:45:05

The court says.

Anything further?

00:11:45:05 - 00:11:46:07

Elaine says, no.

00:11:46:07 - 00:11:47:08

The court says,

All right, we'll get

00:11:47:08 - 00:11:48:23

a copy of this order for you.

00:11:48:23 - 00:11:49:18

And then Ms..

00:11:49:18 - 00:11:51:29

Hoff said, I hope Your Honor had

a great vacation, by the way.

00:11:51:29 - 00:11:55:00

And the court said,

okay, I the court is in recess.

00:11:56:16 - 00:11:57:23

And that is kind of the end

00:11:57:23 - 00:12:01:04

of the part of the hearing

that's relevant for us.

00:12:01:04 - 00:12:04:21

At the very end of that hearing,

entering the final judgment.

00:12:05:10 - 00:12:07:04

But the court says, well,

00:12:07:04 - 00:12:10:04

so where this suspension

bond will come from,

00:12:10:04 - 00:12:11:14

we don't know yet,

00:12:11:14 - 00:12:15:26

but someone will be putting up

these suspension bond there.

00:12:15:27 - 00:12:17:16

You know,

I'm sure they will be working

00:12:17:16 - 00:12:19:09

with the bond company

to put it up

00:12:19:09 - 00:12:20:20

and put up collateral for it.

00:12:20:20 - 00:12:25:03

But we will see 10.3 million

plus 6% interest is just a lot.

00:12:25:18 - 00:12:26:06

But let's

00:12:26:06 - 00:12:29:08

look at how Amber Heard

was paying for her lawyers,

00:12:29:14 - 00:12:32:02

because we've learned

quite a lot about it

00:12:32:12 - 00:12:35:13

in a group of lawsuits.

There are two.

00:12:35:23 - 00:12:37:23

The first lawsuit is Travelers

Insurance

00:12:37:23 - 00:12:40:08

versus New York

Marine Insurance.

00:12:40:15 - 00:12:43:17

I'm going to truncate those two

travelers in New York Marine

00:12:44:02 - 00:12:46:02

because they are

suing each other

00:12:46:02 - 00:12:48:08

because they have both insured

Amber Heard.

00:12:48:21 - 00:12:51:23

The other one is New York Marine

suing Amber Heard directly,

00:12:52:09 - 00:12:55:08

both of these are in California

in federal court

00:12:55:08 - 00:12:58:19

because the insurance policies

were issued as homeowners

00:12:58:19 - 00:13:00:20

policies and umbrella policies

00:13:00:20 - 00:13:03:00

or general policies

in California.

00:13:03:00 - 00:13:03:26

We're not going to get into

00:13:03:26 - 00:13:06:00

the whole nitty gritty of these,

but we're going to go over

00:13:06:00 - 00:13:08:15

the things that we've learned

about Amber Heard defense

00:13:08:26 - 00:13:11:27

and what was going on behind

the scenes with the lawyers.

00:13:12:06 - 00:13:16:07

Because it's

really interesting stuff.

00:13:17:10 - 00:13:17:25

So the first

00:13:17:25 - 00:13:20:21

lawsuit we're looking at

is the first amended complaint

00:13:20:29 - 00:13:23:27

from Travelers Insurance

versus New York Marine.

00:13:23:27 - 00:13:25:15

And we're going

to look at the allegations

00:13:25:15 - 00:13:28:27

and then we're going to go

look at the answer from New York

00:13:28:27 - 00:13:32:28

Marine to get a little bit

more of the facts in this case.

00:13:32:28 - 00:13:34:23

So what travelers,

00:13:34:23 - 00:13:36:17

commercial insurance

company travelers

00:13:36:17 - 00:13:40:21

is looking for with New York

Marine is declaratory judgment

00:13:40:27 - 00:13:43:05

an equitable contribution?

00:13:43:05 - 00:13:45:17

What that means

is that they are looking for

00:13:45:17 - 00:13:48:02

the judge to declare something,

to make a ruling.

00:13:48:02 - 00:13:50:20

This is what it is to decide

a matter of law

00:13:50:20 - 00:13:52:12

as it applies to the facts

00:13:52:12 - 00:13:55:14

and for equitable contribution

of defense expenses.

00:13:55:14 - 00:13:58:00

Hey, we paid for this.

00:13:58:11 - 00:14:00:24

Pay us back or pay us your part.

00:14:01:08 - 00:14:02:17

So let's look at the facts here

00:14:02:17 - 00:14:04:20

and the allegations

from travelers.

00:14:05:16 - 00:14:07:23

What I appreciate

about the insurance lawsuits

00:14:07:23 - 00:14:11:07

is they are really concise

in their facts.

00:14:11:07 - 00:14:13:17

They're just written

in a very direct way

00:14:13:24 - 00:14:16:18

and it makes it

just so easy to go through.

00:14:16:18 - 00:14:18:04

Thank you to the lawyers

00:14:18:04 - 00:14:20:06

from Travelers and New York

00:14:20:06 - 00:14:22:18

Marine

for just getting to the point

00:14:22:28 - 00:14:25:22

and just putting it out

on paper. Just thank you.

00:14:26:01 - 00:14:28:20

Thank you. Thank you.

00:14:28:20 - 00:14:31:10

Defendant, New York Marine

and General Insurance Company.

00:14:31:10 - 00:14:32:17

And they call them pro site.

00:14:32:17 - 00:14:33:22

I don't know why

00:14:33:22 - 00:14:35:27

but in the case

they are calling them pro site.

00:14:35:27 - 00:14:38:15

I have been calling them

New York Marine in the document,

00:14:38:15 - 00:14:41:07

you will see it as pro

site, literally.

00:14:41:07 - 00:14:43:04

I have no idea

why I didn't research it,

00:14:44:03 - 00:14:44:26

but they're saying that

00:14:44:26 - 00:14:48:02

defendant, New York Marine

failed to meet its obligation

00:14:48:02 - 00:14:50:26

to provide its and travelers

mutual insured.

00:14:50:26 - 00:14:52:24

Amber

Heard, a California resident

00:14:52:24 - 00:14:56:01

with independent counsel

to defend the insured.

00:14:56:05 - 00:14:57:01

Amber heard

00:14:57:01 - 00:14:59:08

in an underlying

defamation action,

00:14:59:15 - 00:15:01:18

which is a breach of

its insurance policy

00:15:01:18 - 00:15:03:15

and its obligations.

00:15:03:15 - 00:15:05:01

New York Marine didn't

00:15:05:01 - 00:15:08:23

pay for independent counsel

for Amber Heard.

00:15:09:05 - 00:15:10:11

They go on to allege that

00:15:10:11 - 00:15:13:03

it has unfairly forced travelers

to pay

00:15:13:19 - 00:15:15:27

pro site's proper

share of defense costs.

00:15:16:07 - 00:15:18:10

Hey, we had to pay

for all the lawyers.

00:15:18:10 - 00:15:20:10

Travelers

has been damaged by this conduct

00:15:20:10 - 00:15:23:18

and it is entitled to a judgment

in the form of a declaration.

00:15:23:18 - 00:15:26:14

The pro site was obligated

to provide the mutual

00:15:26:14 - 00:15:27:25

insured with a proper defense.

00:15:27:25 - 00:15:30:13

Your Honor, tell Marine

00:15:31:06 - 00:15:36:24

General Pro site

that they had to pay Amber Heard

00:15:36:25 - 00:15:39:00

legal defense.

They had to pay for the lawyers.

00:15:39:15 - 00:15:41:27

We paid for all of it.

They have to pay their part.

00:15:42:24 - 00:15:43:23

Don't worry.

00:15:43:23 - 00:15:45:12

We're going to get into

00:15:45:12 - 00:15:49:11

whether they have to pay

or not in the second lawsuit.

00:15:49:17 - 00:15:51:22

So just just don't

get ahead of ourselves.

00:15:51:22 - 00:15:53:15

We're going to talk about it.

Don't worry.

00:15:53:15 - 00:15:56:12

They say that under the doctrine

of equitable contribution,

00:15:56:12 - 00:15:58:14

travelers

is entitled to reimbursement

00:15:58:20 - 00:16:01:08

from pro site

of at least half of the moneys

00:16:01:08 - 00:16:04:14

traveler has spent so far

to defend their mutual insured

00:16:04:21 - 00:16:07:22

with proper counsel and adequate

experts and vendors.

00:16:08:02 - 00:16:11:19

Travelers paid the attorneys,

the experts and vendors.

00:16:12:00 - 00:16:12:24

And they're going to tell you

00:16:12:24 - 00:16:15:10

how much they spent in attorneys

fees in a little bit.

00:16:15:16 - 00:16:17:07

And if you're sitting here

going, but, Emily,

00:16:17:07 - 00:16:19:04

I watched this whole trial

on your channel

00:16:19:04 - 00:16:21:15

and I remember when Amber Heard

was on the stand saying,

00:16:21:15 - 00:16:24:29

I've paid over

$6 million to defend this case.

00:16:25:17 - 00:16:26:16

What did she mean?

00:16:26:16 - 00:16:30:13

Well, she was using

I paid and travelers

00:16:30:13 - 00:16:32:11

paid synonymously

00:16:32:11 - 00:16:34:12

because travelers

makes it very clear

00:16:34:12 - 00:16:37:22

in this litigation

that they paid, not Amber Heard.

00:16:37:29 - 00:16:39:21

Did Amber heard

pay for the insurance?

00:16:39:21 - 00:16:41:21

We don't know who paid

for the insurance policy,

00:16:42:01 - 00:16:43:09

but we know that travelers

00:16:43:09 - 00:16:49:04

was paying for adequate experts,

vendors and proper counsel.

00:16:49:11 - 00:16:50:26

Why did they say proper counsel?

00:16:50:26 - 00:16:53:26

There's an argument over

whether the insurance company

00:16:53:26 - 00:16:57:21

picks the attorney or whether

the insurer picks the attorney.

00:16:57:28 - 00:17:00:09

It's an argument

that we are going to skip over

00:17:00:09 - 00:17:00:29

pretty quickly

00:17:00:29 - 00:17:03:19

because the facts that Maureen,

00:17:03:22 - 00:17:07:20

New York Maureen lays out are

very interesting on that point.

00:17:07:20 - 00:17:12:06

And so we will get there

when well, when we got there,

00:17:13:07 - 00:17:15:28

they lay out

information about the policies

00:17:15:28 - 00:17:18:11

that travelers

issue to homeowners policy

00:17:18:22 - 00:17:24:14

starting in November 14th, 2018,

and ended November 14th, 2019.

00:17:24:24 - 00:17:26:05

And then New York.

00:17:26:05 - 00:17:29:13

Maureen issued a policy

that was a commercial general

00:17:29:18 - 00:17:31:19

liability insurance policy

00:17:31:19 - 00:17:36:10

between January 18th, 2018

and sorry, July 18th, 2018

00:17:36:16 - 00:17:38:16

and July 18th, 2019.

00:17:38:16 - 00:17:42:04

So both of these are covering

from 2018 to 2019.

00:17:42:11 - 00:17:46:16

Remember that defamatory article

came out in December 2018?

00:17:46:23 - 00:17:50:17

So it falls

under both of these policies.

00:17:51:00 - 00:17:53:09

They talk about the underlying

defamation action,

00:17:53:09 - 00:17:55:24

which we know about in March

2019,

00:17:56:00 - 00:17:58:09

Heard was sued in Virginia

00:17:58:15 - 00:18:01:26

over the article Travelers

Response to the tender,

00:18:01:26 - 00:18:04:07

the tender being Amber Heard

going to her insurance company

00:18:04:07 - 00:18:07:12

being like,

I'm insured, I'm sued handle it

00:18:08:20 - 00:18:10:23

that they accepted

responsibility.

00:18:10:23 - 00:18:12:09

They offered to pay

for independent

00:18:12:09 - 00:18:15:27

defense counsel of Amber

Heard's own selection, subject

00:18:15:27 - 00:18:18:14

to rate limitations

under the California civil code.

00:18:18:28 - 00:18:21:11

And that traveler has paid

the fees.

00:18:21:24 - 00:18:24:05

Travelers has paid

00:18:24:05 - 00:18:27:20

the fees of the mutually insured

independent defense counsel,

00:18:28:11 - 00:18:31:16

travelers paid the fees.

00:18:33:07 - 00:18:35:19

They said that

pro site accepted its obligation

00:18:35:19 - 00:18:38:07

to defend the insured

under our reservation of rights.

00:18:38:15 - 00:18:40:21

Meaning if we don't have to,

we're not going to.

00:18:40:21 - 00:18:42:27

That's a very,

very brief summation,

00:18:43:07 - 00:18:45:21

but we'll see it in the other

lawsuit.

00:18:45:21 - 00:18:47:26

Pro cites reservation

triggered the mutual insurers

00:18:47:26 - 00:18:50:04

right to independent counsel

under California law.

00:18:50:12 - 00:18:52:03

And then they go through

the California law.

00:18:52:03 - 00:18:55:06

The judge made

a lot of rulings about this.

00:18:55:11 - 00:18:58:12

So we're not going to dove

into that tangent of it.

00:18:58:17 - 00:19:00:25

If there are any insurance

00:19:01:02 - 00:19:03:13

attorneys

listening, I'm not ignoring it.

00:19:03:13 - 00:19:06:20

It just is way deeper

than our purposes here today.

00:19:06:20 - 00:19:09:18

They said that Pro cites

reservation of rights

00:19:09:18 - 00:19:10:17

letters triggered

00:19:10:17 - 00:19:12:11

the fact that Amber Heard

was allowed

00:19:12:11 - 00:19:14:02

to choose independent counsel,

00:19:14:02 - 00:19:16:11

and they allege that instead

00:19:16:11 - 00:19:19:11

they picked the counsel

for Amber Heard.

00:19:20:08 - 00:19:23:08

They also said that pro site

sent an email

00:19:23:08 - 00:19:27:18

to travelers on September

30, 2019, encouraging travelers

00:19:27:25 - 00:19:30:11

to revise its revision of rights

in such a way

00:19:30:18 - 00:19:33:17

as to avoid having

to provide the mutual insured

00:19:33:18 - 00:19:34:08

Amber Heard

00:19:34:08 - 00:19:38:01

with independent defense Counsel

by Independent Defense Counsel

00:19:38:01 - 00:19:40:12

in defense counsel of Amber

Heard's choice

00:19:40:19 - 00:19:42:29

not of the insurance

companies choice,

00:19:42:29 - 00:19:45:26

and said in

the email, according to this

00:19:46:25 - 00:19:48:18

allegation,

00:19:48:18 - 00:19:50:03

that the reservation of rights

00:19:50:03 - 00:19:53:13

under the intentional acts

exclusion is not necessary

00:19:53:22 - 00:19:55:22

as coverage for willful acts

00:19:56:02 - 00:19:59:11

is not insurable

as a matter of public policy,

00:19:59:16 - 00:20:02:00

just like punitive damages.

00:20:02:00 - 00:20:07:05

This is really the basis

of the other lawsuit

00:20:07:26 - 00:20:16:06

that the insurance coverage is

not applicable to willful acts.

00:20:16:19 - 00:20:17:25

And if you're sitting there

going,

00:20:17:25 - 00:20:21:21

wait a sec, defamation against

public figures involves malice.

00:20:21:21 - 00:20:23:23

It isn't malice,

just willfulness.

00:20:23:23 - 00:20:27:13

Yes, yes, it is.

And we will get to it.

00:20:28:15 - 00:20:30:12

So they go on in this email,

00:20:30:12 - 00:20:33:11

as it's alleged in this lawsuit,

to say if you reserve rights

00:20:33:11 - 00:20:34:26

by simply saying, quote,

00:20:34:26 - 00:20:37:22

To the extent that California

law does not permit an insurer

00:20:37:22 - 00:20:40:20

to indemnify the insured,

no indemnity can be provided.

00:20:41:05 - 00:20:44:08

You address both the willful

acts and punitive damages.

00:20:44:08 - 00:20:45:21

Insurance doesn't cover that,

00:20:45:21 - 00:20:47:29

and you can still control

the defense as

00:20:47:29 - 00:20:50:08

there is no conflict of interest

under California law.

00:20:50:22 - 00:20:52:02

What the judge ruled

00:20:52:02 - 00:20:54:15

in other motions regarding

00:20:54:15 - 00:20:57:19

this is that this is not under

California law.

00:20:57:25 - 00:20:58:21

This is Virginia.

00:20:58:21 - 00:21:00:22

They're Virginia attorneys

in a Virginia court,

00:21:00:22 - 00:21:02:06

though,

the insurance policies are

00:21:02:06 - 00:21:03:28

governed under California law.

00:21:03:28 - 00:21:06:06

The attorney conflict

rules of Virginia

00:21:06:06 - 00:21:09:07

are what's going to apply.

00:21:09:07 - 00:21:11:16

That's a whole deep

dove into insurance.

00:21:11:24 - 00:21:13:09

They're saying that pro site

00:21:13:09 - 00:21:16:08

instead appointed

defense counsel of its choosing

00:21:16:16 - 00:21:19:13

and refused demands by heard

00:21:19:21 - 00:21:22:24

and by travelers

to participate in the defense

00:21:22:24 - 00:21:26:09

with counsel of the insureds

choosing Amber Heard.

00:21:27:10 - 00:21:30:03

They say that this was

compounded by a breach of duty

00:21:30:03 - 00:21:33:19

to defend duty to defend

that defamation lawsuit

00:21:33:28 - 00:21:36:25

by having its appointed counsel

do next to nothing and quote

00:21:36:25 - 00:21:38:05

unquote, piggybacking

00:21:38:05 - 00:21:40:21

on the work of the mutual

insurance independent counsel

00:21:40:28 - 00:21:42:02

paid for by travelers.

00:21:42:02 - 00:21:45:21

So we now have allegations

that there were attorneys

00:21:45:21 - 00:21:47:18

hired by travelers

00:21:47:18 - 00:21:51:21

and attorneys hired by New York

Marine One, not hire

00:21:51:29 - 00:21:54:26

attorneys hired by Amber Heard

and paid for by the insurance

00:21:55:06 - 00:21:56:13

travelers is alleging

00:21:56:13 - 00:21:59:10

they let Amber Heard choose

whoever she wanted, make us aid.

00:21:59:18 - 00:22:01:24

But they're saying that New York

Marine

00:22:01:24 - 00:22:05:27

chose the attorneys for Amber

Heard and did not participate

00:22:05:27 - 00:22:08:10

with travelers in letting her

choose her own attorneys.

00:22:08:10 - 00:22:10:14

That's

what they're alleging here.

00:22:10:14 - 00:22:12:13

Then they say that pro sites

appointed counsel

00:22:12:13 - 00:22:16:23

withdrew from representation

of Heard November 20, 2020

00:22:17:06 - 00:22:21:11

and that pro site advised

travelers on January 21, 2021

00:22:21:17 - 00:22:22:06

that it would pay

00:22:22:06 - 00:22:25:12

50% of the fees and costs

incurred by the independent

00:22:25:12 - 00:22:26:06

defense counsel

00:22:26:06 - 00:22:28:29

after November 20, 2020,

after the time

00:22:28:29 - 00:22:32:25

where their attorneys

withdrew from representation.

00:22:33:18 - 00:22:35:24

Then they get into the disputes,

00:22:35:24 - 00:22:38:23

the declaratory,

the declaratory judgment.

00:22:39:02 - 00:22:45:08

They are seeking a declaration

against New York Marine saying

00:22:45:14 - 00:22:47:18

duty to defend

since the underlying action

00:22:47:18 - 00:22:49:00

was tendered to it.

00:22:49:00 - 00:22:50:13

And through the present process,

00:22:50:13 - 00:22:53:17

it is obligated under the policy

to defend the insurer.

00:22:53:23 - 00:22:56:24

You have to provide

money for the legal defense

00:22:57:26 - 00:22:59:25

duty to

defend with independent counsel.

00:22:59:25 - 00:23:01:19

Not only do

you have to provide attorneys,

00:23:01:19 - 00:23:04:15

you have to let the insurer pick

the attorneys

00:23:05:04 - 00:23:08:17

breach of duty to defend the pro

site, failed to meet its duty

00:23:08:24 - 00:23:10:28

to defend the insured

in the underlying action,

00:23:10:28 - 00:23:13:14

and has failed to properly

defend the insured

00:23:13:14 - 00:23:16:17

with independent defense

counsels of the insureds.

00:23:16:20 - 00:23:17:27

Choosing

00:23:17:27 - 00:23:20:03

then obligation

to reimburse travelers

00:23:20:13 - 00:23:24:06

because they had an obligation

to defend is what they're saying

00:23:24:06 - 00:23:26:19

that now

they have to reimburse travelers

00:23:26:24 - 00:23:28:19

for at least half of the fees,

costs

00:23:28:19 - 00:23:30:20

and expenses

incurred by travelers

00:23:31:06 - 00:23:32:24

obligation to pay fees and costs

00:23:32:24 - 00:23:34:04

incurred by independent counsel.

00:23:34:04 - 00:23:37:14

Hey, we've been paying all the

fees and costs for the lawyers.

00:23:37:14 - 00:23:39:21

You have to pay for the lawyers.

00:23:39:21 - 00:23:42:02

They say travelers is informed

and believes that pro site

00:23:42:02 - 00:23:44:15

disputes travelers right to each

and every one of the foregoing

00:23:44:21 - 00:23:47:14

your honor rule

as a matter of law on the facts

00:23:48:03 - 00:23:50:23

that the and declare this relief

00:23:51:15 - 00:23:54:20

because once you declare this

relief then they can follow up.

00:23:55:08 - 00:23:57:11

Then they're also asking in

count two

00:23:57:18 - 00:24:01:26

for equitable

contribution. Pay us, pay us,

00:24:02:28 - 00:24:03:29

pay us.

00:24:03:29 - 00:24:06:15

So let's get into the facts

a little bit more

00:24:06:21 - 00:24:10:00

on what pay us really means.

00:24:10:00 - 00:24:12:11

It makes it so easy.

So go find out for yourself.

00:25:51:24 - 00:25:53:27

Let's get back to today's

episode.

00:25:54:22 - 00:25:57:17

So in

their answer to this lawsuit,

00:25:58:18 - 00:26:00:19

New York,

Maureen was like, Cute.

00:26:00:19 - 00:26:02:02

We deny everything.

00:26:02:02 - 00:26:05:02

And this is typical

in an answer to a lawsuit.

00:26:05:03 - 00:26:05:27

We deny this.

00:26:05:27 - 00:26:08:11

We deny that we don't have

enough information to deny

00:26:08:29 - 00:26:11:17

these are our affirmative

defenses, etc.

00:26:12:11 - 00:26:14:00

So we're not going to go

through the general denials

00:26:14:00 - 00:26:16:11

because it's like deny,

deny, deny,

00:26:16:11 - 00:26:19:04

but then they also countersued.

00:26:19:17 - 00:26:21:09

So aside

from the general denials

00:26:21:09 - 00:26:22:18

we get the counterclaim

00:26:22:18 - 00:26:26:06

and the counterclaim gives us

all of the tea.

00:26:26:06 - 00:26:27:29

The counterclaim tells us

what's going on

00:26:27:29 - 00:26:30:08

with these lawyers,

and I'm here for it.

00:26:30:26 - 00:26:33:07

So in the counterclaim,

00:26:33:07 - 00:26:36:08

New York, Maureen acknowledges

that travelers had a policy

00:26:37:03 - 00:26:39:29

that went from the same dates

that that New York

00:26:39:29 - 00:26:42:19

Maureen had a commercial general

liability policy

00:26:43:03 - 00:26:44:08

that Amber

00:26:44:08 - 00:26:47:12

Heard was sued in Virginia

for defamation in March:

00:26:47:22 - 00:26:50:28

that New York Maureen accepted

the insureds

00:26:50:28 - 00:26:54:00

defense and said,

in or about September 4th, 2019,

00:26:55:07 - 00:26:57:25

the insured tendered the

underlying action to New York.

00:26:57:25 - 00:27:00:10

Maureen So Amber Heard

sent it to New York.

00:27:00:10 - 00:27:04:05

MAUREEN For insurance coverage

on September 4th, 2019.

00:27:04:18 - 00:27:07:04

And they say upon information

and belief, they also tendered

00:27:07:04 - 00:27:09:28

the underlying actually

travelers on the same day.

00:27:10:11 - 00:27:13:24

They say on October 1st, 2019,

New York, Maureen accepted

00:27:14:04 - 00:27:17:13

the insureds defense subject

to a reservation of rights.

00:27:17:14 - 00:27:18:14

Hey, we're not going to pay

anything.

00:27:18:14 - 00:27:19:28

We don't have to by law.

00:27:19:28 - 00:27:22:18

And they appointed the law

firm of Cameron McEvoy

00:27:22:18 - 00:27:26:14

P LLC to defend the assured

in the underlying action.

00:27:26:25 - 00:27:29:16

This is the key for me.

00:27:29:16 - 00:27:33:01

At the time

it appointed Cameron McEvoy

00:27:33:01 - 00:27:36:01

to represent the insured

in the underlying action camera.

00:27:36:01 - 00:27:39:25

McEvoy was already representing

the insured in that litigation,

00:27:39:25 - 00:27:43:08

having

been retained by the insured.

00:27:45:02 - 00:27:47:10

Oh what?

00:27:47:10 - 00:27:50:02

So they appointed the attorney

00:27:50:02 - 00:27:54:24

that had already been hired

by Amber Heard.

00:27:54:24 - 00:27:57:10

Weird, weird.

00:27:57:19 - 00:28:00:18

So all of the argument over

independent counsel

00:28:00:18 - 00:28:02:26

I don't think is on point

00:28:02:26 - 00:28:07:03

because Amber Heard had already

hired these attorneys

00:28:07:10 - 00:28:10:21

when they said, okay,

we will appoint these attorneys,

00:28:10:21 - 00:28:12:07

we're

appointing these attorneys.

00:28:12:07 - 00:28:15:05

The attorneys

that you already retained

00:28:15:12 - 00:28:19:24

independently, making them

that independent attorneys.

00:28:20:13 - 00:28:23:05

They say that Cameron McEvoy

is located in Fairfax, Virginia.

00:28:23:05 - 00:28:23:17

And you know what?

00:28:23:17 - 00:28:26:06

They don't allege the Cameron

McEvoy is so fucking glad

00:28:26:06 - 00:28:27:28

that they are not involved

in all of this.

00:28:27:28 - 00:28:30:01

But I think we can read

between the lines here.

00:28:30:15 - 00:28:32:11

That's just me being cheeky.

00:28:32:11 - 00:28:34:21

Cameron McEvoy is located in

Fairfax, Virginia,

00:28:35:04 - 00:28:37:06

and the attorneys

retained to defend the insured

00:28:37:06 - 00:28:39:19

in the underlying action

are licensed in Virginia,

00:28:39:19 - 00:28:42:25

not California, relevant

to the other provisions

00:28:42:25 - 00:28:45:17

we talked about in appointing

00:28:46:05 - 00:28:49:07

Cameron McEvoy, New York,

Maureen expressly instructed

00:28:49:11 - 00:28:53:09

that firm that it was to serve

as lead counsel.

00:28:53:09 - 00:28:57:09

You've already been retained.

You are lead counsel.

00:28:58:00 - 00:29:02:13

Traveler accepted the insureds

defense on October 7th after

00:29:02:29 - 00:29:03:23

New York Maureen

00:29:05:01 - 00:29:06:17

and travelers agreed to

00:29:06:17 - 00:29:08:21

assume the defense

and the underlying action

00:29:09:24 - 00:29:12:26

travelers on October 7th, 2019

00:29:13:02 - 00:29:14:22

sent a reservation of rights

letters

00:29:14:22 - 00:29:16:23

to provide the insured

with independent counsel

00:29:17:09 - 00:29:20:15

following traveler's October 7th

Reservation of Rights letter,

00:29:20:23 - 00:29:21:26

the insured retained

00:29:21:26 - 00:29:23:08

and travelers has funded

00:29:23:08 - 00:29:25:19

the insureds defense

through New York based attorney

00:29:25:25 - 00:29:29:12

Roberta Kaplan of the law firm

Kaplan, Hecker and Fink.

00:29:29:22 - 00:29:32:03

And we saw that with

00:29:33:15 - 00:29:36:06

we saw that

in the early depositions

00:29:36:06 - 00:29:37:19

that were played in the trial,

00:29:37:19 - 00:29:39:15

that the early depositions

were done

00:29:39:15 - 00:29:42:15

by this attorney,

Roberta Kaplan, not by a lane.

00:29:43:17 - 00:29:45:21

Remember the date

that the other attorneys

00:29:45:21 - 00:29:47:27

heated themselves in 2020?

00:29:47:27 - 00:29:50:15

I wonder if this has anything

to do with it

00:29:50:15 - 00:29:53:12

in or about June 2020,

the insured replaced

00:29:53:12 - 00:29:57:04

the Kaplan firm with Virginia

based licensed attorney Elaine

00:29:57:10 - 00:30:00:23

Brett, a host of the law firm

Charlson.

00:30:00:23 - 00:30:03:06

Brett

Cohen, Brown and Neidl Haft.

00:30:04:11 - 00:30:08:22

Hmm. Although Travelers

has permitted the insured

00:30:08:22 - 00:30:10:07

and both the Kaplan

00:30:10:07 - 00:30:11:23

and Brett Huff firms

00:30:11:23 - 00:30:14:02

to retain and utilize

other attorneys and firms

00:30:14:02 - 00:30:16:08

to assist in the representation

of the insured.

00:30:16:15 - 00:30:19:07

The Kaplan firm and subsequently

the Brett Huff firm

00:30:19:12 - 00:30:21:18

were the only firms

funded by travelers

00:30:21:18 - 00:30:24:26

who were primarily responsible

for the defense.

00:30:25:14 - 00:30:27:19

They go on to talk about

the fact

00:30:27:19 - 00:30:31:26

that the insurance company

can limit the rates,

00:30:32:12 - 00:30:35:23

and they say that travelers

did not enforce the provision

00:30:35:23 - 00:30:39:14

of the civil code

that allows independent counsel

00:30:39:14 - 00:30:41:29

retained and funded by travelers

to reduce its rates,

00:30:42:09 - 00:30:42:21

they said.

00:30:42:21 - 00:30:45:07

Instead, travelers

permitted the independent

00:30:45:07 - 00:30:47:15

counsel retained by the insurer

to fund

00:30:48:25 - 00:30:51:06

and funded by travelers

to bill and receive payment

00:30:51:06 - 00:30:54:19

at independent counsel's

own usual and customary rates.

00:30:54:27 - 00:30:56:25

Rates

which are higher than, quote,

00:30:56:25 - 00:30:57:10

the rates

00:30:57:10 - 00:30:59:26

which are actually paid

by travelers, quote

00:31:00:01 - 00:31:01:21

to attorneys retained by it

00:31:01:21 - 00:31:02:23

in the ordinary course

00:31:02:23 - 00:31:03:18

of business,

00:31:03:18 - 00:31:05:29

in the defense of

similar actions in the community

00:31:05:29 - 00:31:08:21

where the claim arose

or is being defended.

00:31:09:01 - 00:31:11:28

So in this counterclaim,

00:31:12:15 - 00:31:14:03

you're getting New York,

Maureen, saying,

00:31:14:03 - 00:31:16:05

why should we have to pay half

00:31:16:11 - 00:31:18:28

when you agreed to pay

like all the shit,

00:31:19:12 - 00:31:22:19

but you're not following

the codes to the code.

00:31:23:01 - 00:31:24:07

When you follow the code,

00:31:24:07 - 00:31:26:22

you would have been paying them

a normal rate

00:31:27:02 - 00:31:29:20

for the type of defense

that the insurance company

00:31:29:20 - 00:31:32:16

would normally pay,

not whatever their billing

00:31:32:25 - 00:31:36:00

they say specifically on or

about June 10th, 2020, Travelers

00:31:36:00 - 00:31:39:01

entered into an agreement with

independent counsel Bret Aloft.

00:31:39:07 - 00:31:43:03

Alain, pursuant

to which independent counsel

00:31:43:03 - 00:31:44:29

was permitted

to bill at its usual

00:31:44:29 - 00:31:47:21

and customary hourly rates

which aren't listed here.

00:31:47:21 - 00:31:50:02

Bummer without limitation

00:31:50:08 - 00:31:53:11

on those amounts subject

to a purported agreement

00:31:53:17 - 00:31:56:29

that this would constitute

a quote capped fee of 2.5

00:31:56:29 - 00:32:01:07

million through

post-trial motions. Interesting.

00:32:02:03 - 00:32:05:02

As the February:

independent counsel

00:32:05:02 - 00:32:09:03

had exhausted the purported fee

cap of $2.5 million

00:32:09:29 - 00:32:13:11

by February 2021, Brett

00:32:13:27 - 00:32:17:11

had exhausted

the fee cap of 2.5 million,

00:32:17:20 - 00:32:20:10

but trial remained

more than a year away.

00:32:20:21 - 00:32:23:07

They go on to allege that

rather than holding independent

00:32:23:07 - 00:32:24:20

counsel to the agreement,

00:32:24:20 - 00:32:29:06

Hey, you said 2.5 million

through post-trial motions.

00:32:29:06 - 00:32:32:13

The rest

is on you, friend. Good luck,

00:32:34:01 - 00:32:34:14

they say.

00:32:34:14 - 00:32:35:10

On May 18th,

00:32:35:10 - 00:32:38:05

2021, travelers

entered into a new agreement

00:32:38:05 - 00:32:39:18

with independent counsel

00:32:39:18 - 00:32:43:22

pursuant to which it violated

the original tact fee

00:32:43:29 - 00:32:46:20

and agreed to continue

to pay independent counsel's

00:32:46:27 - 00:32:51:04

ongoing fees and costs.

Oh, we had an agreement.

00:32:51:04 - 00:32:53:15

But what about an information

and belief?

00:32:53:15 - 00:32:55:23

By way of the new May 18, 2021,

00:32:55:29 - 00:32:57:02

travelers exercised

00:32:57:02 - 00:33:00:09

its rights under Civil Code:

to limit payments

00:33:00:09 - 00:33:01:18

to independent counsel

00:33:01:18 - 00:33:04:03

to rates

that were actually paid by it

00:33:04:03 - 00:33:06:17

to other attorneys retained in

the ordinary course of business.

00:33:06:23 - 00:33:09:13

So that's when they started

limiting what could be charged

00:33:09:13 - 00:33:12:24

filing as a result

and on information and belief,

00:33:12:24 - 00:33:16:06

travelers has occurred

in excess of $5 million

00:33:16:14 - 00:33:17:10

in defense

00:33:17:10 - 00:33:18:12

fees and costs

00:33:18:12 - 00:33:21:10

incurred action

with the underlying action

00:33:21:17 - 00:33:22:29

far in excess of the amounts

00:33:22:29 - 00:33:24:18

which travelers was required

to pay.

00:33:24:18 - 00:33:26:02

In light

of the provision of civil code

00:33:26:02 - 00:33:29:05

2860 C upon

which it could have relied.

00:33:29:05 - 00:33:32:04

Remember, this motion is filed

00:33:32:11 - 00:33:36:24

in case we didn't see it on

March 25th, 2022.

00:33:37:12 - 00:33:44:06

So as of March 25th, 2022,

before this goes to trial, trial

00:33:44:06 - 00:33:46:12

being the most expensive part

of any litigation,

00:33:47:03 - 00:33:50:16

before this goes to trial,

they have exhausted over

00:33:50:16 - 00:33:54:11

$5 million in defense fees.

00:33:54:29 - 00:33:56:16

They then get into

what was going on

00:33:56:16 - 00:33:58:01

between the attorneys

00:33:58:01 - 00:34:00:06

following travelers in New York

Marine's respective

00:34:00:06 - 00:34:02:12

reservations of rights travelers

in New York.

00:34:02:12 - 00:34:03:25

Maureen's,

through the representative

00:34:03:25 - 00:34:05:08

counsel funded by it, proceeded

00:34:05:08 - 00:34:07:11

to defend the insured

in the underlying action.

00:34:07:26 - 00:34:09:14

Independent counsel retained

00:34:09:14 - 00:34:11:25

by the insured

and funded by travelers

00:34:11:27 - 00:34:15:10

consistently refused

to cooperate with Cameron McEvoy

00:34:15:15 - 00:34:18:13

and deliberately obstructed

and prevented Cameron McAvoy's

00:34:18:13 - 00:34:19:11

active involvement

00:34:19:11 - 00:34:23:19

in the defense of Amber Heard,

specifically independent counsel

00:34:23:19 - 00:34:25:21

retained by the insured

and funded by Travelers

00:34:26:00 - 00:34:29:18

permitted Cameron McAvoy and its

attorneys from communications

00:34:29:18 - 00:34:31:10

with the Court

in opposing counsel

00:34:31:10 - 00:34:33:10

from and from case

related emails,

00:34:34:00 - 00:34:37:18

they say that the Travelers

Attorneys, Alain at one point

00:34:38:13 - 00:34:41:06

also frequently admitted

and failed to notify or include

00:34:41:06 - 00:34:43:20

Cameron McEvoy in discussions

in consideration of

00:34:44:05 - 00:34:45:18

strategy and tactics,

00:34:45:18 - 00:34:47:01

and frequently failed to include

00:34:47:01 - 00:34:49:10

Cameron

McEvoy pleadings and notices,

00:34:49:17 - 00:34:52:10

including by removing them

from the pleadings, proofs

00:34:52:10 - 00:34:53:06

of services

00:34:53:06 - 00:34:54:27

and other notices in

00:34:54:27 - 00:34:58:25

or about August 20, 20,

the Bretton Hall

00:34:58:26 - 00:35:01:20

firm entered into a stipulation

to continue the trial

00:35:01:20 - 00:35:05:00

without including Cameron McAvoy

in discussion.

00:35:05:09 - 00:35:08:19

Expensive, by the way,

delaying trial for two years

00:35:09:18 - 00:35:12:24

without notifying

counsel of such stipulation,

00:35:12:29 - 00:35:14:26

without including them

on the stipulation

00:35:14:26 - 00:35:16:11

or proofs of services

00:35:16:11 - 00:35:18:07

with the result

that Cameron McEvoy

00:35:18:07 - 00:35:20:16

learned of the stipulation

and Court's order

00:35:21:07 - 00:35:24:08

through the court's

publicly available docket,

00:35:25:00 - 00:35:27:04

travelers has inhibited

and obstructed

00:35:27:04 - 00:35:28:25

York Marine's

ongoing participation

00:35:28:25 - 00:35:31:10

in the defense of the insured

by failing to timely provide

00:35:31:10 - 00:35:32:26

copies of status reports,

00:35:32:26 - 00:35:34:28

invoices, billing

audits and proofs of payment.

00:35:35:08 - 00:35:39:04

Despite the requests,

they then go on to say in March.

00:35:39:15 - 00:35:41:10

On March 21st, 2020,

00:35:41:10 - 00:35:45:23

an email to attorney Sean

Roche of the Camera McEvoy firm.

00:35:46:03 - 00:35:48:28

Pamela Johnson, Travelers

Assistant VP and Claim

00:35:48:28 - 00:35:50:29

Professional and others

00:35:50:29 - 00:35:52:18

talked about the billing

00:35:52:18 - 00:35:55:19

and sharing of work, stated

that her conversation

00:35:55:19 - 00:35:58:01

with independent counsel

did not go well.

00:35:58:15 - 00:36:04:12

So this is an attorney from

Cameron McEvoy, hired by Amber

00:36:04:12 - 00:36:06:23

Heard and being paid by New York

00:36:06:23 - 00:36:09:26

Marine is trying to communicate

with Alain

00:36:10:12 - 00:36:13:03

and that the conversation

with Elaine, quote unquote,

00:36:13:11 - 00:36:16:09

did not go well.

00:36:16:09 - 00:36:17:04

Great

00:36:17:11 - 00:36:20:07

notwithstanding Travelers

March 2020, conversation

00:36:20:07 - 00:36:23:07

with them, independent counsel

continued to refuse to cooperate

00:36:23:07 - 00:36:26:20

with or facilitate Cameron

McAvoy's active participation

00:36:26:24 - 00:36:28:18

in the defense. Interesting

00:36:29:20 - 00:36:30:27

travelers thereafter both

00:36:30:27 - 00:36:31:23

failed to insist

00:36:31:23 - 00:36:32:25

that independent

00:36:32:25 - 00:36:34:26

counsel cooperate

with and facilitate

00:36:35:04 - 00:36:37:27

the full and active

participation of Cameron McEvoy

00:36:38:19 - 00:36:41:01

in the defense of the insured

and the underlying action

00:36:41:25 - 00:36:45:13

as a result of independent

counsel's refusal. Elaine.

00:36:45:13 - 00:36:47:18

As a result of independent

counsel's refusal

00:36:47:18 - 00:36:49:10

to cooperate with or facilitate

00:36:49:10 - 00:36:50:23

its active participation

00:36:50:23 - 00:36:52:23

in the defense

of the underlying action

00:36:52:23 - 00:36:55:17

and travelers failure to obtain

a required cooperation.

00:36:55:24 - 00:36:58:14

On November six, 2020,

the camera McEvoy firm

00:36:58:16 - 00:37:01:11

withdrew its representation

of Amber Heard.

00:37:01:11 - 00:37:05:11

In this action or in that

action, the defamation action.

00:37:06:23 - 00:37:13:02

So so travelers

paid Alain at all

00:37:14:08 - 00:37:19:02

amber Heard had previously hired

the Cameron McEvoy firm

00:37:20:03 - 00:37:22:03

and New York

00:37:22:03 - 00:37:25:08

Marine appointed them

and was willing to pay them.

00:37:25:08 - 00:37:27:28

And then they couldn't work

with Alain.

00:37:28:03 - 00:37:29:26

And Alain, it sounds from

00:37:29:26 - 00:37:32:05

these allegations, was leaving

them off of everything.

00:37:33:04 - 00:37:35:29

So now they are countersuing.

00:37:35:29 - 00:37:38:01

New York

Marine is countersuing travelers

00:37:38:09 - 00:37:39:25

for declaratory relief

00:37:39:25 - 00:37:42:04

that they didn't owe a duty

to defend the insured

00:37:42:04 - 00:37:46:27

through independent counsel,

that they that New York

00:37:46:27 - 00:37:49:18

Marine did not fail to provide

a defense to its insured.

00:37:50:07 - 00:37:52:14

They tried that.

00:37:52:19 - 00:37:55:06

They don't have to reimburse

travelers

00:37:55:06 - 00:37:57:07

because travelers

doesn't isn't entitled

00:37:57:07 - 00:38:00:29

to 50% of all of the wild fees

they agreed to

00:38:01:17 - 00:38:06:12

and the preferable lines out

all of the declarations

00:38:06:12 - 00:38:08:19

that they want

and the declaratory relief.

00:38:08:19 - 00:38:10:28

But that's not all,

00:38:11:17 - 00:38:16:01

because then New York

Marine sued Amber Heard

00:38:18:02 - 00:38:19:05

Weird.

00:38:20:03 - 00:38:24:21

So on July eight,

20, 22, New York Marine

00:38:24:21 - 00:38:26:26

Insurance

Company sued Amber Heard.

00:38:27:09 - 00:38:29:22

And then they filed

a first amended complaint

00:38:29:23 - 00:38:32:07

on July 11th, 2022,

00:38:32:15 - 00:38:35:27

as we lovingly refer to them

on this channel, SAC.

00:38:36:21 - 00:38:38:02

It's a fact.

00:38:38:10 - 00:38:40:18

Let's take a look briefly

00:38:40:25 - 00:38:44:19

at what New York Marine is suing

Amber Heard over.

00:38:45:04 - 00:38:47:04

It's mostly

for declaratory relief.

00:38:47:24 - 00:38:50:07

It's mostly for declaratory

relief.

00:38:50:24 - 00:38:53:05

The factual allegations,

the insurance policy,

00:38:53:15 - 00:38:56:09

New York

Marine issued policy number,

00:38:56:09 - 00:38:59:09

policy number

listed to named insured

00:38:59:18 - 00:39:03:13

under the Black Sky

Ink and Amber Heard for a policy

00:39:03:13 - 00:39:07:11

period of July 18th, 2018

to July 18th, 2019,

00:39:07:11 - 00:39:09:27

with a per occurrence

limit of $1,000,000.

00:39:10:28 - 00:39:13:11

They say that the

policy includes comprehensive

00:39:13:11 - 00:39:15:19

personal liability coverage,

00:39:15:19 - 00:39:19:13

and they define personal injury

in that comprehensive coverage

00:39:19:13 - 00:39:21:18

to mean injury

other than bodily injury

00:39:21:23 - 00:39:24:12

arising out of one

or more enumerated offenses,

00:39:24:19 - 00:39:27:10

including oral or written

publication of material

00:39:27:16 - 00:39:30:08

that slanders or libels

a person or organization,

00:39:30:14 - 00:39:32:24

including other forms

of defamation.

00:39:32:24 - 00:39:35:02

So defamation is covered.

00:39:35:02 - 00:39:37:19

They go through the underlying

lawsuit and talk about the fact

00:39:37:19 - 00:39:40:03

that Johnny Depp sued

Amber Heard in Virginia

00:39:40:09 - 00:39:40:22

on March

00:39:40:22 - 00:39:44:12

1st, 2019, for The Washington

Post op ed published

00:39:44:12 - 00:39:47:01

December 18th and 19th, 2018.

00:39:47:13 - 00:39:50:08

They said that on October 1st,

they accepted the defense.

00:39:50:08 - 00:39:52:00

As we heard

in the other lawsuit,

00:39:52:00 - 00:39:53:22

and that at the time

00:39:53:22 - 00:39:58:00

Amber Heard had already retained

Cameron McEvoy, LLC,

00:39:58:08 - 00:40:01:20

and this insurance company

went ahead and appointed

00:40:01:26 - 00:40:05:15

that law firm for the defense

to be paid by the insurance.

00:40:06:02 - 00:40:08:19

They say the underlying action

proceeded to trial April

00:40:08:19 - 00:40:12:04

11th on May 27th, the court

issued the jury instructions.

00:40:12:04 - 00:40:13:07

They attached them

00:40:13:07 - 00:40:16:03

because the jury instructions

make it clear that

00:40:16:03 - 00:40:18:23

this is a willful defamation.

00:40:19:14 - 00:40:21:05

They say that on June 1st,

00:40:21:05 - 00:40:23:05

the jury in the underlying

action returned a verdict

00:40:23:05 - 00:40:25:03

in favor of Depp for all counts.

00:40:25:03 - 00:40:27:13

And then they talk about what

the judgment was,

00:40:27:13 - 00:40:30:14

including the 2 million award

and then the 5 million

00:40:30:26 - 00:40:33:03

punitive damages

and then the statutory cap.

00:40:33:24 - 00:40:36:06

Their first course of action

is declaratory relief

00:40:36:06 - 00:40:39:07

as to plaintiff's duty to

indemnify hurt for the judgment

00:40:39:25 - 00:40:41:14

order under the policy.

00:40:41:14 - 00:40:43:10

We're not paying the judgment.

00:40:43:10 - 00:40:44:11

Remember, they're fighting

00:40:44:11 - 00:40:46:15

in the other court

over the lawyers

00:40:46:15 - 00:40:50:17

and now they're saying we're not

paying the judgment either.

00:40:50:17 - 00:40:51:21

Just incorporates everything.

00:40:51:21 - 00:40:53:29

By reference, California

Insurance Code

00:40:53:29 - 00:40:57:21

533 provides

that an insurer is not liable

00:40:58:02 - 00:41:04:23

for a loss caused by the willful

act of the insured. Well

00:41:06:00 - 00:41:09:08

well,

that that that is a problem.

00:41:10:10 - 00:41:16:10

Willful is literally

the part of the defamation

00:41:16:20 - 00:41:19:10

that makes this defamation

hard to prove.

00:41:19:20 - 00:41:24:11

There has to be malice, malice,

willfulness, willful regard.

00:41:24:12 - 00:41:27:23

The truth you have to intended.

It's not a whoopsie.

00:41:27:28 - 00:41:30:26

You have to know that the shit

that you're saying is false.

00:41:31:01 - 00:41:33:13

And the jury found it

specifically.

00:41:33:13 - 00:41:35:29

And in the jury verdict forms

that we've been over,

00:41:36:03 - 00:41:40:11

when it asks, was it willful,

it says yes on all three,

00:41:40:24 - 00:41:42:20

which is why they attached them

as an exhibit

00:41:42:20 - 00:41:45:09

in this case, they attach

all of the jury verdict forms

00:41:45:18 - 00:41:48:08

and the jury instructions

as exhibits to this lawsuit.

00:41:48:22 - 00:41:50:01

But the California insurance

00:41:50:01 - 00:41:54:11

code five, three, three says,

no, sir, no, ma'am.

00:41:54:25 - 00:41:56:19

An insurer,

00:41:56:21 - 00:41:58:03

the insurance company here

00:41:58:03 - 00:41:59:23

is not liable

00:41:59:23 - 00:42:04:00

for a loss caused by the willful

act of the insured.

00:42:04:22 - 00:42:08:15

But he is not exonerated

by a negligence of the insured.

00:42:09:02 - 00:42:11:13

If it was regular defamation,

00:42:11:13 - 00:42:14:27

not of a public figure,

no malice, it's covered.

00:42:15:04 - 00:42:17:25

But when it's malice,

it's not covered.

00:42:18:14 - 00:42:22:06

This provision is an implied

exclusionary clause,

00:42:22:06 - 00:42:25:19

which by statute is read

into all insurance policies.

00:42:25:19 - 00:42:27:23

Under California law,

00:42:27:23 - 00:42:31:05

the jury's factual findings

establish that Hurd's liability

00:42:31:09 - 00:42:34:04

is caused

by the willful acts of Hurd.

00:42:35:00 - 00:42:37:14

And then they go on to say,

Therefore, we don't have to pay.

00:42:38:08 - 00:42:41:00

Due to the actual and present

controversy described above,

00:42:41:08 - 00:42:43:02

we're asking

for declaratory relief,

00:42:43:02 - 00:42:46:05

and then they ask for other

types of declaratory relief,

00:42:46:05 - 00:42:47:12

including that

00:42:47:12 - 00:42:51:00

the plaintiff insurance company

did not have to indemnify

00:42:51:00 - 00:42:53:10

Hurd for the judgment

and the underlying action.

00:42:53:29 - 00:42:54:15

They're asking

00:42:54:15 - 00:42:57:07

for declaratory relief

that the insurance company does

00:42:57:07 - 00:43:00:06

not have to defend Hurd

in the underlying action

00:43:00:18 - 00:43:03:18

this is going to say, look,

we don't have to defend.

00:43:03:18 - 00:43:05:22

So even if the other court is

like, you should share cause

00:43:05:28 - 00:43:07:05

we didn't have a duty to defend.

00:43:07:05 - 00:43:10:12

So this is kind of overlapping

a little bit with the other

00:43:10:19 - 00:43:13:05

interesting insurance

company action.

00:43:13:05 - 00:43:17:18

So they don't have to defend you

because of the willfulness,

00:43:17:26 - 00:43:20:04

meaning that if they had paid

for the defense,

00:43:20:24 - 00:43:22:09

could they go

claw back and be like,

00:43:22:09 - 00:43:24:26

the jury found

this to be willful, pay us back.

00:43:25:17 - 00:43:28:19

We don't have

to we don't have to pay you

00:43:29:20 - 00:43:31:18

or we

don't have to pay your lawyers.

00:43:31:18 - 00:43:33:19

The fourth cause is declaratory

relief

00:43:33:29 - 00:43:36:21

as to the insurance company's

duty to defend

00:43:37:08 - 00:43:40:04

and indemnify

Amber Heard under the policy

00:43:40:15 - 00:43:44:10

and then they reiterate that

in their prayer for relief.

00:43:44:18 - 00:43:48:23

So what we have

here is two lawsuits.

00:43:48:23 - 00:43:52:07

One is the insurance companies

fighting among each other

00:43:52:14 - 00:43:54:17

travelers

has paid over 5 million.

00:43:54:17 - 00:43:58:16

We know that that's gone well up

since March for Amber Heard.

00:43:58:16 - 00:44:01:11

And they want New York

Marine to pay half.

00:44:01:19 - 00:44:03:01

And New York Marine sued Amber

00:44:03:01 - 00:44:05:11

Heard and said,

we don't have to pay you shit.

00:44:06:01 - 00:44:08:28

And New York Marine countersued

travelers and said

00:44:09:02 - 00:44:10:22

we're not paying half.

00:44:10:22 - 00:44:11:15

Also,

00:44:11:15 - 00:44:15:09

you done messed up

because you let the attorneys

00:44:15:09 - 00:44:17:22

wild out with the fees

you boxed out.

00:44:17:22 - 00:44:21:12

Our attorneys, our attorneys

needed and that is on you.

00:44:21:26 - 00:44:23:06

So we're not paying it.

00:44:23:06 - 00:44:28:25

So could Amber Heard be on

the hook for her own judgment?

00:44:29:10 - 00:44:31:18

Yes. Could travelers

00:44:31:24 - 00:44:34:04

under their policy

be on the hook for some of it?

00:44:34:21 - 00:44:35:23

Possibly.

00:44:35:23 - 00:44:38:25

Have we seen all of what

travelers on the hook for? No.

00:44:39:03 - 00:44:41:21

But what we do know is

travelers has footed the bill

00:44:41:26 - 00:44:43:29

for a lane at all.

00:44:43:29 - 00:44:47:11

So when Amber Heard testified

that she has paid

00:44:47:16 - 00:44:50:09

$6 million, was that true?

00:44:50:09 - 00:44:53:00

It depends

what the definition of paid is.

00:44:53:15 - 00:44:57:08

If I paid you mean your

insurance company paid it, then?

00:44:57:08 - 00:44:58:07

I guess.

00:44:58:07 - 00:45:00:11

But if I paid you mean

you donated it?

00:45:00:11 - 00:45:02:25

Well, those things are just

synonymous,

00:45:02:25 - 00:45:04:25

so it's not really paid.

00:45:04:25 - 00:45:06:24

I don't understand

why Amber Heard doesn't

00:45:06:24 - 00:45:08:28

understand

what paying for shit is.

00:45:08:28 - 00:45:12:25

How you not know what paying for

things means. But she doesn't.

00:45:13:24 - 00:45:16:11

So with that,

00:45:16:11 - 00:45:17:16

we're going to see,

00:45:17:16 - 00:45:19:13

I think, an uptick

in the litigation

00:45:19:13 - 00:45:21:12

and between the two insurance

companies.

00:45:21:12 - 00:45:23:20

Now that this case is completed,

00:45:23:20 - 00:45:24:29

we are going to see this back in

court.

00:45:24:29 - 00:45:26:27

It's set for a jury trial.

00:45:26:27 - 00:45:28:22

Will that go to trial?

I don't know.

00:45:28:22 - 00:45:29:28

But if it does, oh, boy.

00:45:29:28 - 00:45:30:20

I want to see

00:45:30:20 - 00:45:33:18

I want to see the emails

between all the attorneys. Yep.

00:45:33:23 - 00:45:36:00

I want to see the attorneys

fighting it out.

00:45:36:06 - 00:45:39:01

What were those conversations

with Lane like before?

00:45:39:01 - 00:45:41:15

The other counsel was like,

We are bouncing.

00:45:41:28 - 00:45:43:00

I want to know

00:45:43:00 - 00:45:45:07

and I'm very interested

to see what's going to happen

00:45:45:07 - 00:45:47:20

with this declaratory relief

against Amber Heard.

00:45:47:29 - 00:45:50:24

I don't think under the law

in California,

00:45:50:24 - 00:45:53:06

I cannot see a situation

00:45:53:15 - 00:45:56:14

where New York Marine has to pay

a dime of this judgment.

00:45:57:04 - 00:45:59:13

And we will see

if Amber Heard puts up

00:45:59:19 - 00:46:02:28

that suspension

bond for the appeal shortly.

00:46:03:12 - 00:46:05:13

It's a whole lot of money,

00:46:05:13 - 00:46:07:08

but it's a whole

nother situation

00:46:07:08 - 00:46:10:07

where Amber Heard's like

what paid, pledged, donated,

00:46:10:14 - 00:46:11:25

insured, whatever.

00:46:12:25 - 00:46:14:19

It's all the same.

00:46:14:21 - 00:46:16:20

It's not all the same

to these insurance companies

00:46:16:20 - 00:46:18:22

that are duking this out

in court.

00:46:18:22 - 00:46:19:26

Don't forget to let me know

00:46:19:26 - 00:46:23:27

what questions you have about

today's episode on social media

00:46:23:27 - 00:46:26:14

if you are a member

in our member spaces.

00:46:26:14 - 00:46:29:16

When I put up discussion

threads, this is not over.

00:46:29:16 - 00:46:32:28

So even though we have

all of the appeals going on,

00:46:33:04 - 00:46:35:29

we're still going to have

these insurance cases going on.

00:46:35:29 - 00:46:38:24

We are not out of the woods

on this yet.

00:46:39:08 - 00:46:41:00

Thank you

so much for being here.

00:46:41:00 - 00:46:42:16

Thank you

for spending another episode

00:46:42:16 - 00:46:46:20

of The Emily Show with the

I will see you in the next one.

00:46:46:29 - 00:46:48:23

May your wife I be strong.

00:46:48:23 - 00:46:50:27

May your toilet paper

be plentiful.

00:46:50:27 - 00:46:53:07

May it not be too hot

where you live.

00:46:53:18 - 00:46:55:28

May your gas not be $7 a gallon.

00:46:56:09 - 00:46:59:07

May your family be well,

may you not have monkeypox,

00:46:59:15 - 00:47:02:29

and may the odds be ever

in your favor.

00:47:02:29 - 00:47:05:19

The outros just going to keep

growing because

00:47:06:08 - 00:47:09:08

weird shit just keeps happening.

Thank you for being here.

00:47:09:16 - 00:47:11:19

Thank you for being so honored.

I'll see you in the next one.
