Blizzard / Activision Sued California over “Frat” Environment and Staggering Harassment

Blizzard/Activision has been sued over allegations of staggering harassment and workplace discrimination that have resulted in female employees being forced to leave their jobs to protect themself and one employee taking her own life. The allegations are triggering and raw, but sadly not unfamiliar to many women in male-dominated fields. Hopefully, this suit will signal to other women in gaming that it may be safe to sue, to push for fair treatment, to end harassment, and to demand equal pay.

The Britney Spears Conservatorship Case Brief

The 13 year Britney Spears conservatorship has really come to the forefront of conversation in the last few months. While many were aware of the conservatorship and the Free Britney movement has been pushing for Britney to be released from her conservatorship for years…but for everyone else, this is a lot of catch-up to get up to speed on what is happening with this case. Today’s episode is a little shorter to help condense what the most controversial aspects of the conservatorship are and what I think is coming down the road next.

Jen Shah and the dry contact defense

Real Housewife of Salt Lake City Jen Shah was shockingly arrested in March 2021 while Bravo cameras were rolling. It really was something. During her arraignment, we learned that the Government believes that Jen Shah was at the TOP of a telemarketing scheme. She was charged with Conspiracy to commit Wire Fraud and Conspiracy to commit Money Laundering. Shah’s attorney’s filed a substantial motion asking the court to dismiss the indictment and then asked the court to suppress all of Jen Shah’s post-arrest statements alleging, in part, that she couldn’t voluntarily waive her Miranda rights because her contacts were dry…I am not joking. The Government responded with quite a lot of facts that we hadn’t heard before including that Jen Shah was deposed in a substantial FTC lawsuit with regards to the same acts and companies well before she agreed to be a part of Real Housewives of Salt Lake City.

There is a lot of information here so get a snack and let’s get into it.

Bill Cosby Conviction Overturned

Well….the 5th Amendment is still a thing and the Bill Cosby conviction has been overturned because of statements used in his second trial. In this episode, I break down why the court made the ruling they did, my thoughts on the ruling, and how the Constitution informs our criminal laws.

Britney Speaks.

On June 23, 2021, Britney Spears spoke at a status conference for her Conservatorship. It was a rare moment in open court, broadcast for the media and the world to hear how she was feeling. She spoke clearly and quickly as if she was worried she wouldn’t be allowed to get all of her statements out, or that she wouldn’t be heard. It’s clear that in 13 years of this conservatorship what the #FreeBritney movement has feared is largely true. What Britney detailed is heartbreaking. Her lack of autonomy has been widely speculated on and she detailed it painfully. I would love to hear your thoughts on social!

The NCAA gets schooled by the Supreme Court

This week I am covering the Supreme Courts’ ruling in the NCAA case which opens the door for student-athletes to be paid, to receive additional educational-related benefits, and to (I believe) become Student-Athlete Influencers. I also cover the updates to the Colin v. Cuthbert great cake debate. Finally, there are some updates in the Tom Girardi case and my thoughts on the Housewife and the Hustler. Would love to hear your thoughts on these cases. Let me know on social media @TheEmilyDBaker.

Where is the line between protecting academia, canceling culture, and the unacceptable treatment of students? Yale Law School is having a reckoning with their former power couple who are both now under varying levels of restrictions by the University.  There needs to be accountability in academia for behavior that crosses the line, but there needs to be room for professors to help students explore critical thinking and unpopular opinions. I would love to hear your thoughts on this??

Dave Ramsey and the Rightous Living lawsuit.

Where is the line between behavior your employer can control and behavior that is none of their business? Today I am exploring two lawsuits centered around Financial Guru Dave Ramsey.  Dave Ramsey’s company Ramsey Solutions is under fire for having a ‘cult-like workplace environment and firing a pregnant employee for a violation of the company’s righteous living policy.

Sephora sued for Defamation

We are seeing a new wave of lawsuits that illustrate a new twist to the push-pull between a companies right to choose who they work with and employee and discrimination based on ideology or activities that occur outside of work. From Amy Cooper (The Central Park Karen) suing her former employer after being fired for the viral incident in central park to Beauty Influencer Amanda Ensing suing Sephora for alleged defamatory remarks made when cutting ties with her. Conservative ‘comedian’ and commentator Steven Crowder has said he is suing YouTube for demonetizing and striking his channel, he is ostensibly suing for discrimination based on viewpoint, but we will see. The line between workplace behavior and outside-of-work behavior is clearly blurring due to social media. So where do we go from here?

Shannon Beador Sues her Divorce Attorney & Wins Her Defamation Suit

Shannon Beador is suing her Divorce Attorney alleging that she was not properly advised during her divorce from David Beador. This includes allegations that the attorney didn’t account for the kids college tuition payments, that the Divorce attorney told her to settle the case because they weren’t prepared for trial and that she had to give up her USC endowment to her Ex. In other RHOC legal news, Shannon was also sued for defamation by Jim Bellino and subsequently won the suit with her successful Anti-Slapp motion.

Erika Girardi Objects to appointment of Ronald Richards

The Trustee in the Bankruptcy Case for Girardi Keese (Tom Girardi’s Law Firm) is seeking to appoint Twitter Legal Commentator Ronald Richards as the special litigator tasked with tracking down any loans or funds moved from Girardi Keese to Erika Girardi or her companies. Much like Richards has had a lot to say about Erika on Twitter, Erika’s lawyers have a lot to say in their objection.

The Craziest YouTube Lawsuit Yet!

This is the wildest YouTube lawsuit I have seen yet. It involves alleged copyright violations over a PayPerView fight involving controversial YouTube creator Jake Paul. The allegations here make a lot of conclusory statements but no actual facts. The court threw out this lawsuit once, how long will it take for this to be thrown out again?? My guess is not long. Buckle up for a course in what not to do as a lawyer.

Will Erika Girardi be sued by the Bankruptcy Trustees?

Both Bankruptcy Trustees are seeking to hire special counsel to sue Erika Girardi to claw back any property or loans provided to her or her companies. I have wondered when this would happen. If these motions are approved by the court we will likely see Erika Girardi and her companies sued within the Bankruptcy.

Let them Eat Cake! M&S sues Aldi over Colin the Caterpillar.

Launched over 30 years ago M&S’s Colin the Caterpillar is an icon. A regular fixture at birthday parties of those young and old alike (I am assured by my British friends). However grocer Aldi now finds itself in court over their Cuthbert the Caterpillar cake. While this case is playing out over Trademark rights in the High Court, it is also playing out on Twitter in the most British way.

Saying Goodbye. LuLaRoe 4.75 million settlement, Nike Satan Shoes, Taylor Swift & Evermore, Johnny Depp & The Sun UK

It’s so hard….to say goodbye… to yesterday… I am kidding, kind of. In this episode I take a look at some of the cases we have covered that are all the way over.

Nike v. MSCHF over the Satan Shoes settled and was dismissed. Taylor Swift v. Evermore and Evermore v. Taylor Swift both settled. Johnny Depp v. The Sun UK, he lost at trial and his appeal was denied. Finally LuLaRoe settles for 4.75 million with the State of Washington over Pyramid Scheme allegations.

Satan Shoes & Real Housewife Jen Shah’s Indictment

A lot has happened in the legal world in the last week. MSCHF announced the Satan Shoes collab with Lil Nas X, but used a Nike Air Max shoe for the collab. Nike doesn’t approve of this shoe and has now sued MSCHF over the shoes. A court granted a temporary restraining order over it and this suit is pushing forward quickly. With the Erika Jayne and Tom Girardi case I thought we had seen the biggest Housewife scandal we would see. I was WRONG! The Jen Shah indictment, arrest and arraignment is wild. Seeing a Housewife indicted on Wire Fraud and Money Laundering charges is wild.

The Girardi Case Updates, Financial Document, and Erika objects!

Since the recording of this episode the State Bar has filed charges against Tom Girardi Accusing him of Misappropriating millions from clients. I have linked the latest reporting down below.

Currently, the most active courts in this case (due to the Bankruptcy stay in most courts), are the two Bankruptcy cases and the Conservatorship case. Some of the most interesting updates are the newly filed financial documents in the bankruptcy case and the fact that Erika has filed an objection in the bankruptcy court.

A Cheer Mom, Deep fakes, and a Homecoming Queen

The College Admission scandal showed everyone the lengths some parents will go to in order to further their children. While Parents in those cases used to access and money to steal opportunities for their children other parents have found different ways to try to do something similar. Both stories I cover in this episode are pending criminal prosecution as of 3-24-21.

First, a Pennsylvania cheer mom used technology to create ‘deep fake’ videos and images of teens on her daughter’s cheer squad in a seeming attempt to discredit those teens by showing that they were engaging in behavior that goes against the teams’ honor code. The Victory Vipers are an elite cheer team in Doylestown Pa. Law enforcement said that the woman used apps on her phone to alter photos and videos of three teens, then masked her cell phone number to send those to coaches on the team and teens themselves. The District Attorney of Bucks County charged the 50-year-old mom with 3 counts of cyber harassment of a child and 3 counts of harassment, both misdemeanors.

Second, a Flordia Elementary School Assistant Principal and her teen daughter were arrested for allegedly using the mother’s access to school accounts to change over 100 votes in the Homecoming election. It’s alleged that they accessed the school’s system to changes votes from a singular IP address. They have been charged with one count each of offenses against users of computers, computer systems, computer networks, and electronic devices, a third-degree felony; unlawful use of a two-way communications device, a third-degree felony; criminal use of personally identifiable information, a third-degree felony; and conspiracy to commit these offenses, which is a first-degree misdemeanor.

COVID…One Year Later

I still can’t believe it’s been a year since parts of the United States went into lockdown. We are all still dealing with Covid, lockdowns, distance learning, and sorting out what the next steps look like. In this episode, my husband and I talk about what the year of lockdown has been like for us. Lockdown in Los Angeles was a very strange experience, but I always feel that sharing these stories and experiences helps process it and have a conversation with you about it.

From Burger King to Critical Thinking

On international women’s day, Burger King tweeted “Women belong in the kitchen”… later they subtweeted (tweeted under the original tweet) that only 20% of professional chefs are women and that they are giving scholarships to support women. It was poorly done…it caused a lot of outrage…that may have been the point. But it raises the question, how do we see past the outrage and emotion to get to the facts? Let’s talk about practical critical thought.
