On October 21, 2021, Cinematographer Halyna Hutchins was shot and killed on the New Mexico set of the movie Rust. Lead Actor and Producer Alec Baldwin was approximately four feet from Hutchins on set with a replica revolver that was loaded with a live bullet. Director Joel Souza was also shot and injured when the bullet passed through Hutchins. Since the shooting multiple lawsuits have been filed, Alec Baldwin has made numerous statements and appeared in an ABC Special talking through his perspective of events on set and when the shooting happened.  From there, numerous lawsuits were filed, a police investigation began, search warrants were issued.  The Sheriff’s and District Attorney in New Mexico have repeatedly stated that the investigation into the death of Halyna Hutchins is ongoing.

Halyna Hutchins husband and son have now filed a wrongful death lawsuit naming producers, production companies, Baldwin, and those in charge of the props and weapons. This suit includes some details we have seen before in other lawsuits and some that are new.  From my perspective it’s clear that there was negligence on someone's part, otherwise, a live round wouldn’t have ended up on the movie set and in the prop weapon, therefore this tragedy wouldn’t have taken place. Though the criminal investigation is still open I am not surprised that the wrongful death lawsuit is underway.
