NOTE. On July 11th after this episode was recorded in advance of her federal trial Jen Shah plead guilty to one count of wire fraud. There is a bonus podcast episode covering the plea and a video breaking it down on YouTube. Jen Shah has maintained her innocence since her arrest and through her attorney was pushing this case forward to trial. Each time the trial was delayed there were objections from Jen’s attorneys. Jen was facing up to 60 years and due to her plea is now only facing 30 years. I am still surprised she plead.

Justice Alito, in delivering the majority opinion for the Supreme Court in Dobbs v. Jackson starts by acknowledging that “[a]bortion presents a profound moral issue on which Americans hold sharply conflicting views”. It is a topic on which discussions of disagreement are difficult to navigate making this case all the more challenging to discuss. On June 24, 2022, the Supreme Court overturned Roe v. Wade a 1974 Supreme Court case that extended constitutional protection to the right to an abortion through the due process clause of the 14th amendment. The Court stated in their holding that the “Constitution does not confer a right to abortion; Roe and Casey are overruled; the authority to regulate abortion is returned to the people and their elected representatives.” The ruling is over 200 pages and includes concurrences from Justices Thomas, Justice Kavanaugh, and Chief Justice Roberts. The Dissent is delivered by Justices Breyer, Sotomayor, and Kagan. In the Dissent they state “[f]or half a century, Roe v. Wade and Planned Parenthood v. Casey have protected the liberty and equality of women. Roe held, and Casey reaffirmed, that the Constitution safeguards a woman’s right to decide for herself whether to bear a child.”
This decision leaves entirely in the hands of the states the right to regulate or not, abortion. I hope that this episode breaks down this case in a way that makes it understandable and gives some insight into how I break down topics that are significantly charged.

During the aftermath of the Depp v. Heard trial, there has been a lot of conversation, mostly from team Heard, about the UK case. It’s been said by both Amber Heard and her counsel that the UK case should have prevented the Virginia case from being brought to trial. Since I haven’t fully broken down the ruling in the Virginia case as to why the UK case wasn’t binding, and since I think we will keep hearing about this ruling, it’s time to break it down. If you are interested in the UK ruling check out that episode of The Emily Show.

Weeks after the jury decided that Amber Heard defamed Johnny Depp this case still isn’t over. The final judgment isn’t even in yet, that’s expected to happen on June 24, 2022, and Amber Heard has continued to talk about the case. During a week-long teaser of the exclusive sit-down interview with Amber Heard NBC released clips of the interview on Monday, Tuesday, and Wednesday, a 20-minute preview was released exclusively on Peacock on Thursday, and finally, the interview was released on Friday. The release of this amount of content of the interview ahead of the interview provides an interesting vantage point for the edits that NBC made. While putting in more content, or taking content out is to be expected, it’s the strange mid-sentence cuts that have caused so much debate.

On August 13, 2019, Todd & Julie Chrisley and their accountant Paul Tarintino were indicted numerous counts of bank fraud and tax-related crimes. A superseding Indictment was charged on February 15, 2022. Their federal trial began in Atlanta Georgia on May 16, 2022, and after just over 3 weeks of evidence and several days of deliberation, all parties were convicted of all counts on June 7, 2022. The Chrisleys remain out of custody until their sentencing is currently scheduled for October 6, 2022.
After the verdict, the Chrisleys attorney told People that they are “disappointed in the verdict” and added, “An appeal is planned.”

Closing arguments are the best part of any trial IMHO (in my humble opinion), as a trial attorney, it was my favorite part of a trial. I tried to prep my cases so that I knew what I wanted to argue in closing. I am sure that the Depp v. Heard Attorneys were working on their closing throughout this case, and during. I prefer the style of Depp’s attorneys, but there were good points made by Heard’s attorneys in closing. I would love to hear what you thought of these closing arguments. Did you find them persuasive?? Did you watch?
Since the verdict was read, both side’s lawyers have had an opportunity to talk to the media, the talking points couldn’t be more different. Heard’s team is arguing that the jury was influenced by social media, that the Judge and Depp’s team suppressed evidence, that Heard was demonized and this verdict sets women back. Team Depp has called many of those statements disappointing while pointing out that the Jury overwhelmingly believed Depp.

A quick episode to break down the verdict in the Johnny Depp v. Amber Heard defamation case. This was a surprising verdict to almost everyone. Johnny Depp won on all three of his causes of action, Amber Heard won on one of her counterclaims.
This trial has been an unexpected six weeks, I will be breaking down the closing arguments next week but we had to talk about this verdict.

The final week of the Johnny Depp v. Amber Heard trial felt like a sprint. The week started still in Amber Heard’s case in chief. Then to both Depp’s and Heard’s Rebuttal witnesses and finishing with closing arguments on May 27, 2022. The Jury is still out and we will see when and if they render a verdict in the coming days. One of the looming factors in week 6 was the clock. The Court gave each side 61 hours and 15 minutes to try their case. During the final week, Heard’s lawyers were fighting for every minute of trial time, something that carried through closing arguments.
Week six also brought out the sassy witnesses and it became clear how much the internet impacted this trial with three witnesses in Depp’s rebuttal that connected to the legal team because this case was being televised. Really interesting stuff happening in court.
What, if any, thoughts do you have about Week 6?

Week 5 of the Johnny Depp v. Amber Heard trial had many witnesses. It also had the bulk of Amber Heard’s case in chief. The stand-out moments were Amber Heard’s cross-examination by attorney Camille Vasquez. A very important part of this case is the time. Each side has 61 hours and 15 minutes to try their case. At the end of Week 5, Depp’s team had 10 more hours of time to finish presenting their case and rebuttal case. This case has been so interesting.

Before the court was dark for a week, Amber Heard was on the stand at the end of week 4 of the Johnny Depp v. Amber Heard Defamation Trial. During this week, we heard from Depp security team member Travis McGivern, Depp’s agent Jack Whigham, a damages expert Richard Marks, Social Medial Expert Douglass Bania, Nurse Erin Falati, and Forensic Accountant Michael Spindler. Then Depp’s team rested their case in chief, and Amber Heard’s team brought a motion to strike Depp’s claims which were denied for two claims and taken under submission by the court for one claim, which will likely be denied later. With that, it began Amber Heard’s case with Clinical and Forensic Psychologist Dr. Dawn Hughes, whose testimony was overshadowed by evidentiary issues. Finally, Amber Heard was called to the stand by her attorney, who called her Laura Amber Heard and not Amber Laura Heard… and that is where week four ended.

The Johnny Depp v. Amber Heard Trial Week 3 has concluded. Johnny Depp has finished his testimony and his case is rounding towards its close, the end of Depp’s testimony was powerful, “Tell the world, Johnny, tell them, I Johnny Depp, a man, I too am a victim of domestic violence”, Amber Heard. Depp responded, “I said ‘Yes, I am”. It was powerful testimony that will likely be remembered as the key piece of testimony from Week 3. But it wasn’t the only powerful testimony, Dr. Shannon Curry, forensic psychologist, testified to diagnosing Amber Heard with Borderline Personality Disorder and Histrionic Personality Disorder. We also got colorful testimony from Alejendaro Romero who testified about not seeing injuries on Heard, and how stressful the case has been for him then, finally, he vapped and drove off. This case has had some very interesting moments…are you watching?

The Johnny Depp v. Amber Heard defamation is well underway at this point, and most of week 2 was consumed with Johnny Depp’s testimony. The cross-examination was wandering and very tough to follow. As we get into week three Depp’s testimony has completed and that will be covered next week. What do you think of this case so far?

The Johnny Depp v. Amber Heard defamation trial is underway, and there has been a lot that has happened. I am covering the first week of testimony including Gina Deuders being excused as a witness and Amber Heard’s girlfriend Eve Barlow being banned from the courtroom. The Blac Chyna lawsuit has also kicked off in Los Angeles against the Kardashian/Jenner family and it’s already getting interesting.

The trial of Johnny Depp v. Amber Heard is underway. Today’s episode is a case brief breaking down the causes of action in this defamation case. There has been quite a lot of litigation in this case leading up to it getting to court for trial. This trial has very high stakes for both parties, a star-studded witness list, and a lot of evidence. The estimates for this trial are that evidence will take six weeks. Johnny Depp has sued Amber Heard for defamation over an OpEd she published without naming him, he is seeking $50 million in damages. Amber Heard has counter sued Depp for defamation for statements his lawyer made calling her statements that she was battered by Depp a hoax, she is seeking $100 million in damages. This jury is in for a whirlwind trial. Thankfully for us, there will be cameras in the courtroom and I will be following along.

We are now over a week out of the Oscars and the fallout from Will Smith slapping Chris Rock on stage isn’t over. From what happened to what the potential legal consequences are it’s time to break it down. Plus, if you were wondering about the difference between Assault and Battery, legally, I’ve got you.
If you’ve been following my coverage of the Ghislaine Maxwell trial you know that I was concerned about the motion for New Trial based on Juror 50’s failure to disclose his past experiences when directly asked on the questionnaire. However, the Judge found that Juror 50 testified credibly, that the failure to disclose was a mistake and not deliberate and that he was not biased against Maxwell and therefore would not have been struck for cause. For those reasons the Court denied the motion and reaffirmed that the sentencing will move forward.

On December 9, 2021 actor Jussie Smollett was convicted of hoaxing a hate crime against himself, and in the course of that hoax made multiple false reports to the police. On March 11, 2022, Smollett was sentenced after the Judge stated to Smollett “you’re just a charlatan pretending to be a victim of a hate crime, and that’s shameful.” The Judge further stated that Smollett has “done real damage to victims of hate crimes” and that he “lied and kept lying”. The Judge sentenced Smollett to 150 days in jail, 30 months of Felony probation, a fine of $25,000, and restitution of a little over $130,000 to the city of Chicago reduced for the $10,000 in forfeited bail bond that Smollett previously paid. On March 16, 2022, the Appellate Court granted Smollett’s request to stay (pause) his sentence pending appeal and he was released from custody. This case feels like it’s been a whirlwind since it started and we need to take a look at everything that has happened to have context for the arguments on appeal and what will happen next.
